Child Custody Laws in Tennessee

Child custody laws are codified in the Tennessee Annotated Code § 36-6-106. According to this code section, the court will always decide custody based on what is in the best interest of the child. The court may look at a number of factors when making this determination, including but not limited to where the residences of each parent are located, whether the child needs stability, and any other factor the court determines relevant. 

The court may make a determination about legal and physical custody. Legal custody allows a parent or parents to make decisions for their child, such as healthcare and education decisions. Physical custody involves the physical location where a child will reside. A parent may be granted sole custody, or parents may share the responsibility with joint custody. 

What Factors Are Taken Into Consideration for Custody?

In determining what is in the best interest of the child, the court may look at several things. If the child is 12 years or older, the court will take their wishes into consideration about where they want to reside. 

Factors a court may take into consideration when determining child custody:

  • The type of relationship a child has with each parent, including whether one parent has performed most of the parenting responsibilities;
  • The parent’s willingness in the past and potential in the future to take on parenting responsibilities, and whether a parent is able to encourage and facilitate a relationship between the child and the other parent;
  • Whether a parent refused to attend a court-ordered parent education seminar;
  • Whether a parent can provide a child with the necessities and whether a parent is the primary caregiver;
  • The emotional needs of the child and their developmental level;
  • Whether a parent is morally, physically, mentally, and emotionally fit to parent the child;
  • A child’s interaction and relationship with their siblings and other relatives; and
  • Evidence of physical or emotional abuse. 

These are only a few of the many factors that a court may look at to determine legal and physical custody. In some cases, the court may grant custody to someone other than a parent if they feel that custody with that person is in the child’s best interest.
